Zoning Board Request Village Change Ordinance Footage

Crivitz"During a public hearing and special meeting of the Crivitz Zoning Board of Appeals on May 23, a variance request of Robert Bemis was discussed. Bemis requested a variance for his property at 1221 Rosa Ave. to Village of Crivitz Ordinance Sec. 13-1-22(4), which states that in residential zoning district accessory buildings shall be limited to two and shall not exceed a total of 1,500 square feet in area.
Bemis, who was present at the meeting, requests to build a 1,500 square foot garage. The new garage would push him over the 1,500 square feet rule. In order to appear before the Zoning board, Bemis needed to combine lot 26 and 27 of his property into one single lot, which was completed. Attached to the application for the variance was a site plan indicating the entire property comprising of the garage, home, and proposed new garage.
During discussion, member Paul Dyer stated that Bemis was in a catch 22 due to the fact that after joining the two parcels into a single one, he could not build because he exceeded the limit of the 1,500 square foot rule of the ordinance. If he would have left the parcels separate, he still would not be able to build a garage due to the rule which states a garage may not be built on a parcel without a home presently on the site. Dyer said he thinks the 1,500 square foot rule for two garages is antiquated and out of date. He suggested that if the upcoming vote does not grant Bemis the variance, he should go back to the Village Board and see if they would entertain the idea of looking at the 1,500 square feet for two garages and change the ordinance to 2,000.
Board member Gene Golla said he faces the same situation regarding his own property, having to have the square footage to meet the ordnance. Porfilio suggested that Bemis pursue the issue with the Village Board. Dyer added that this is the perfect situation to update the old ordinance and to fix it not only for Bemis but for others as well.
The roll call vote taken was unanimous that Bemis be denied the variance. Before the meeting adjourned, Porfilio reiterated that the Zoning Board of Appeals will suggest to the Village Board by way of a letter they entertain the idea of increasing the square footage from 1,500 to 2,000. Bemis will also send a letter to the Village and request the increase as well.
