
Peshtigo Council Revises Ordinances Governing Cigarettes, THC and SignsIssue Date: August 5, 2021 Changes to ordinances governing smoking, possession of THC or Marijuana, and signs were all approved by Peshtigo City Council at its regular monthly meeting on Tuesday, Aug. 3, with all members present.
Before coming to Council for approval the changes had been discussed by the Judiciary Committee at meetings on March 31 and again on July 9, and then drafted by City Attorney David Spangenberg to incorporate the suggestions made by committee members.
In a change from past practice, there were no public hearings on the proposed ordinance changes, since they did not involve zoning or land use regulations.
There was no discussion prior to voting on the THC/Marijuana ordinance, but there had been some hot discussion at the committee meetings. Votes opposing the were cast by Aldermen John Berendt and Richard Berth. Berendt in particular had objected to lack of provision for possession of medically prescribed marijuana. Voting in favor were aldermen Brigitte Schmidt, Debbie Sievert, Keith Klimek and Katie Berman.
The smoking ordinance changes were approved after brief discussion, with Berth casting the sole opposing vote. Before the vote, Berman asked if the only change was changing the legal age for smoking from 18 to 21 in accord with state law, and was assured by Spangenberg that was the case. In committee there had been talk of imposing restrictions that would in effect have prohibited smoking on all public property but those changes were informally rejected by the committee. Berth noted the committee had discussed having an expert come in to discuss some of the issues (marijuana and tobacco), and Mayor Cathi Malke said they had looked into it but he was unable to attend.
When the sign ordinance came up for a vote Berth asked what had been changed, and was told by Sievert that there was a change in allowable total square footage and a definition that a sign can be two sided, but there cannot be two signs side by side. That ordinance revision was approved without dissent.
Malke urged aldermen who had questions on issues coming up on the agenda to stop in ahead of time and get them answered rather than waiting to bring them up at the meeting.
The Finance Committee had recommended using some of the city's American Rescue Plan (ARPA) funds to provide bonuses to essential city employees who had worked through the pandemic. That recommendation was defeated after some fairly heated discussion, but with assurances by some of those who voted against it that they were not opposed to the plan, they just wanted more information.
Vote was Sievert and Klimek in favor and Berendt, Berth and Berman opposed. Schmidt abstained.
The printed agenda for the Council meeting listed the proposed bonuses as $1,500 each for full time employees, $1,000 for 29-hour weekly employees, and $500 to part-time employees who worked as of January 2020. The committee recommendation had been changed by adding a $100 bonus for poll workers, and this appeared to create some confusion an d dissent on the Council.
Use of the ARPA funds for employee bonuses was one of the allocations defined as acceptable by state and federal rule makers. Also acceptable are infrastructure uses, such as for drinking and wastewater expenses, and the remainder Peshtigo's allocation after the bonuses was to be designated for water and sewer utility expenses.
Before the vote, Berth asked for a list of who the bonuses would go to. He asked to have the matter tabled to the next Council meeting, and that apparently has happened. Those who would receive bonuses were to include hourly and salaried employees but not elected officials.
Malke again admonished aldermen to request information and ask questions before the meeting.
Without dissent, Council approved advertising for someone to fill the position of Peshtigo Police Chief in accord with an updated job description approved by the Personnel Committee on July 22, with advertising to start on Wednesday, Aug. 4. Applications are due by 4:30 p.m. on Wednesday, Aug. 25. The committee had approved setting the pay of Interim Police Chief Detective Mike Sievert at $31 per hour retroactive to the date of employment, which followed the June 30 retirement of Chief Rick Badgley.
Retirement of Lt. Joseph Bayer as a volunteer with the Peshtigo Fire Department was accepted with expressions of thanks from Malke and others for his 24 years of service.
Without dissent Council backed recommendations of the Streets and Drainage Committee to grant street use permits to Joe Nystrom for the Historical Day Parade on Saturday, Sept. 25, and to Mayor Malke for the Peshtigo Historical Day and Sesquicentennial celebration on that day.
Also without dissent, Council approved leasing Triangle Park to the Peshtigo Chamber of Commerce as recommended by the Fire, Lighting and Building Committee.
The meeting began with a presentation by Emily Tyner, UWGB Director of Freshwater Strategy on designation of a site on Green Bay - possibly in or near Marinette or Peshtigo, as a National Estuarine Research Reserve site. There was to be a longer, more detailed presentation at Peshtigo School on the evening of Wednesday, Aug. 4, and there had been a presentation at the Marinette county Board meeting on Tuesday, July 27.
