Set New Motions Hearing In McClintock Murder Case

Following a motion hearing on Friday, March 19, wheels remain in motion for a two-week jury trial for McClintock Park murder/rape suspect Raymand Vannieuwenhoven to begin on July 19 before Judge James Morrison in Marinette County Circuit Court Branch II.

A motions hearing is scheduled in Marinette County Circuit Court Branch II at 1:30 p.m. on Thursday, April 8 on as motion related to admisison of evidence on a possible alternate suspect - Robert Lukesh - under the "Denny rule."

Due to modern DNA testing capabilities Vannieuwenhoven, now 84 years old, was identified as the suspect for a double murder and rape that happened in Marinette County's McClintock Park on July 9, 1976.

He was arrested at his home in the Oconto County Town of Lakewood in March of 2019, and has been held since then on $1 million cash bond. He had undergone treatment and evaluation at the Wisconsin State Mental Hospital after being ordered there by the court in March of 2020. He was then then found competent to stand trial. He is currently being held in Marinette County Jail with a 24-hour nurse in attendance due to his poor health.

Due to statutes of limitations, rape charges could not be brought against Vannieuwenhoven, but Judge Morrison ruled on Friday that the DNA evidence obtained by deputies under a pretext can be used to place him at the crime scene, and will be accepted at the trial. In January defense attorneys had filed motions objecting to use of deception to obtain the DNA evidence that led to his arrest.

Vannieuwenhoven is charged two counts of first degree murder as Class U felonies in connection with the 1976 shooting deaths of a Green Bay couple - David Schuldes, who was 25 at the time, and his fiancé, Ellen Matheys, who was 24. Both died of gunshot wounds, but Matheys had been raped before she was shot. Penalty for conviction on First Degree Murder counts in Wisconsin is life in prison.

In the decades following the double homicides, Vannieuwenhoven had led a relatively quiet life in Oconto County, which included marrying and raising a family. He was living alone at his home at 17043 Remus Woods Lane inLakewood at he time of his arrest. The residence is just a few miles west of McClintock park in Marinette County.

At Friday's motions hearing Judge Morrison issued a written ruling that the DNA evidence will be admitted.

Judge Morrison said he was not prepared to rule on a motion related to a possible alternate suspect - Robert Lukesh - under the "Denny rule," and scheduled a follow-up motions hearing for 1:30 p.m. on Thursday, April 8.

Judge Morrison decided in favor of a defense motion to disallow presentation of evidence that Vannieuwenhoven was involved in an assault case in Green Bay alleged to have happened in 1957 and did not appear to include sexual assault.
